Copyright Infringement Policy for Naiya.ng

Naiya.ng ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with applicable intellectual property laws, including the Nigerian Copyright Act.
This Copyright Infringement Policy outlines the procedure for copyright holders to notify us of alleged infringements and the actions Naiya.ng may take in response to such notices.
1. Reporting Instances of Copyright Infringement
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that any content hosted on our Site (Naiya.ng) or accessible through our Services infringes your copyrights, you may submit a notification of alleged copyright infringement.
To be effective, your notification must be in writing and include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Naiya.ng to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
- Information reasonably sufficient to permit Naiya.ng to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury (or an equivalent legal assertion in Nigeria), that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Note: Misrepresenting that material or activity is infringing may subject you to liability for damages. Therefore, if you are not sure whether material available online infringes your copyright, we suggest that you first contact a legal advisor.
2. Naiya.ng's Response to Infringement Notices
Upon receipt of a valid copyright infringement notification, Naiya.ng will:
- Promptly remove or disable access to the allegedly infringing material.
- Notify the user who posted the allegedly infringing material (the "Affected User") that we have removed or disabled access to the material.
- Take reasonable steps to promptly notify the Affected User that we have removed or disabled access. In appropriate circumstances, Naiya.ng may also provide the Affected User with a copy of the infringement notice.
3. Counter-Notification Procedures
If an Affected User believes that the material that was removed or to which access was disabled is not infringing, or that they have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, the Affected User may send a counter-notification to our Designated Copyright Agent.
To be effective, a counter-notification must be in writing and include the following information:
- The Affected User's physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury (or an equivalent legal assertion in Nigeria) that the Affected User has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The Affected User's name, address, and telephone number, and a statement that the Affected User consents to the jurisdiction of the Federal High Court of Nigeria, and that the Affected User will accept service of process from the person who provided the original infringement notification or an agent of such person.
If a counter-notification is received by the Designated Copyright Agent, Naiya.ng may:
- Send a copy of the counter-notification to the original complaining party informing that person that Naiya.ng may replace the removed material or cease disabling it in 10 business days.
- Unless the copyright owner files an action seeking a court order against the Affected User, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at Naiya.ng's sole discretion.
4. Repeat Infringers
It is Naiya.ng's policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

This Copyright Infringement Policy is not intended to be a substitute for legal advice. Copyright holders are encouraged to seek legal counsel to understand their rights and obligations under copyright law. Naiya.ng acts as an intermediary and does not adjudicate copyright disputes.
6. Modifications to Policy
Naiya.ng reserves the right to modify this Copyright Infringement Policy at any time. Any changes will be effective immediately upon posting the revised policy on the Site. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified policy.
